The State of Indiana set to Challenge Constitutional Limits of Executive Power

The theft of Public funds by two Fascist Presidents of the United States will finally go on trial in the Supreme Court.

Last fall Congress approved and President Bush signed the law creating the $700 billion Troubled Assets Relief Program (TARP). Congress specifically said the funds could only be used for financial institutions such as banks, insurance firms and credit unions. However, TARP money was used by the Bush administration to provide a $13.4 billion bridge loan to GM and a $4 billion loan to Chrysler.

In March, Comrade President Obama told America, government would guarantee the warranties for new cars sold by GM and Chrysler, expanding government fascist control in the name of the auto bailout. He also forced the removal of GM CEO Rick Wagoner and announced that Fiat would be purchasing Chrysler, with no legal authority and against congressional provisions.

In early June Comrade President Obama announced the federal government would be spending $30 billion on GM and taking ownership of 60 percent of the company and giving union workers a 17 percent stake in the company ahead of the secured interest of the Indiana pension fund holders.

The Indiana suit addresses this issue by raising the inequity in the deal as structured. If the United States is a country based upon the rule of law where contracts are to be honored, what kind of new society is Comrade President Obama leading this Country into, if by government fiat (no pun intended) it can unfairly favor the interests of the company’s unsecured stakeholders ahead of the secured stakeholders, such as the holders of Indiana pension funds?

This action puts the new National Socialist American Worker’s Party in complete control of the Auto Industry and the precedent to continue nationalizing any area of the American economy in the name of “The Party.”

The U.S. District Court ruling further states, “Plaintiffs’ arguments have even more persuasive force given that a bill, HR 7321, specifically designed to authorize the distribution of TARP funds to auto manufactures passed the United States House of Representatives.” “Passage of that bill by the House, even though not ultimately enacted, raises the question of why was such a bill necessary if the Act already authorized the distribution of TARP funds to the auto industry?” the court continued.

However, U.S. Bankruptcy Court Judge Arthur Gonzalez ruled on June 1 that Indiana did not have the standing to challenge the use of TARP funds. The court of appeals issued a ruling late Tuesday accepting the case.

The Indiana pension funds added: “The Government’s action is not authorized by any statute, including TARP, and violates the unambiguous provisions of the Emergency Economic Stabilization Act (the “EESA”) and the Constitution of the United States.”

The President’s violation of federal law ‘breathtaking’

The agenda of Comrade President Obama is quite clear, and should be a wakeup call for those liberal progressives blind to the unlimited power grab by the executive branch. How can their liberal Marxist-fascist President pit one class of unions, the Indiana teachers, against a union who contributed to his campaign, the UAW, while a foreign corporation, Fiat, receives a financial windfall of at essentially no cost?

There is only one answer, Comrade President Obama principals lie with a new society based upon Marxist-fascist authoritarian rule, let us pray that the supreme court see’s Obama for what he is and for what he is planning to do to American society, and stop this shift of power from the people to the Dictator in Chief.

The Indiana lawsuit is significant because it is the only litigation challenging the constitutionality of this auto bailout, said Andrew Grossman, senior legal policy analyst at The Heritage Foundation.

The US Dollar Cares not for TV Face Time

When Humpty Dumpty fell off the wall that was the end, even if you are Barrack Hussein Obama Comrade President of the United States, with more face time on TV news than the host of any news show, the US economy cannot be put back together again under a socialist regime.

There are basic economic factors that any economy throughout history has used to steal from its subjects, all in the name of the state, that have broken the economic rules that society and the state must live by. By breaking these basic natural rules upon which politics has no influence, that nation is doomed to financial oblivion.

From ancient Rome to modern day America you cannot do the following and survive as a viable nation:

As stated last month by S&P government debt was 100% of GDP

Public borrowing cannot exceed the nation’s ability to repay

In a depression a Nation cannot tax the poor by increasing the price of their food, clothing and transportation by cap and trade global warming taxes upon the gaseous omissions of their livestock and transportation in the name of clean air.

Government cannot steal Banks, Insurance Companies, Car Companies from the same noblemen and bond holders they intend on taxing, telling them it is their patriotic duty on behalf of the State’s new social fascist order to submit and expect them to willingly pay.

When Federal income tax revenues for the prior year fall by 44% it is not a good idea for the Fed to start printing money and buying the treasury’s debt. This will cause the value of the currency to drop and be worthless. When this happens there is nothing a nation can quickly do to stop inflation of its currency

On fears of recession and depression the US dollar rose to $90.00 in March 2009. Since that time the dollar has continued to drop and is today at $78.40, indicating that decisions of the Fed and Treasury are causing the dollar to rapidly lose value. If the dollar does not make a significant attempt to stop the downward trend THIS WEEK the economy is seriously headed for hyperinflation due to the Obama economic policy, no matter how much he wants to blame Bush, Humpty Dumpty has has a Great Fall and has not his bottom yet!

Fascism Takes Control of America Under Democratic Leadership as Spineless Republicans Cower

America has just entered its darkest days as economic fascist policies abound through policy after policy of Comrade President Obama. It should be no surprise that the policies that brought political parties such as the German Nazi’s and Italian Fascist Party of Mussolini in power are now occurring in America. Take for example the closure of Chrysler car dealerships authorized by the White House against only republican supporters while not a one of the democratic/fascist dealerships are closing. Economics on a purely partician basis is a clear tenant of fascist control.

A chain of Arkansas and Missouri Chrysler dealerships aren’t being closed, but many of their local competitors are being eliminated. The owner McClarty is the former Clinton senior aide, his partner Robert Johnson, founder of the Black Entertainment Television, a heavy Democratic contributor.

Take another example that 90% of GM will be owned by the US Government and the UAW socialist labor party. The US government will hold a 72.5% stake in GM while the United Auto Workers would own 17.5%. Americans can now look taxpayer dollars being used to keep Government Motors from going under as Dictators like Obama hate to be made failures through policy decisions that clearly show fascism doesn’t work.

Now to promote fascist values and change the constitution from what the original framers sought to institutionalize a Dictator would need like minded individuals on the Supreme Court. Sotomayor, Comrade President Obama’s Supreme Court pick is a proven fascist and contemplates making the highest court into a vehicle of social change for Marxist-fascist values rather than interpretation of the constitution from the perspective of individual freedom. She will promote class warfare decisions where a society of races compete for jobs rather than those who are most qualified.

Even though America the melting pot established upon individual freedom created the most historic and powerful Nation in the World, a judicial nominee who used empathy and social order as a barometer of social justice rather than what can promote the most individual freedom for all Americans will further the cause of fascism. Her judicial decisions will not be brought to the public eye because of the propaganda media machine under complete control of the Obama Administration will plaster TV screens with feel good and emotional arguments while the principals and policy’s are not considered because of race and gender.

Lets not forget Hitler youth and the fascist party’s ability to control society, to meet its ends and agenda of tyranny, through intimidation and unethical tactics. To promote such an ambitious agenda one needs an unofficial army to carry out it’s political bidding under control of the party. Although illegal in the US Obama has used ACORN for his army of supporters to get elected and is now through congress protecting them from federal prosecution. One must also pay the army and ensure the allocation of federal funds in order to do so. Thanks to fascist’s in the senate such as Barney Frank, the funding of groups like ACORN now under indictment for voter fraud will continue to receive funds to keep the fascists in their seats of power in the congress and senate.

GM Under Control of Fed’s and Unions

The U.S. Treasury would own 72.5 percent of the new GM coming out of a bankruptcy sale process while a trust affiliated with the United Auto Workers union would own 17.5 percent, GM said in a filing with securities regulators.

Fascist Economic Policy in Chrysler Plant Closures

Furor grows over partisan car dealer closings

By: Mark Tapscott ,05/27/09 Evidence appears to be mounting that the Obama administration has systematically targeted for closing Chrysler dealers who contributed to Repubicans. What started earlier this week as mainly a rumbling on the Right side of the Blogosphere has gathered some steam today with revelations that among the dealers being shut down are a GOP congressman and closing of competitors to a dealership chain partly owned by former Clinton White House chief of staff Mack McLarty.

The basic issue raised here is this: How do we account for the fact millions of dollars were contributed to GOP candidates by Chrysler who are being closed by the government, but only one has been found so far that is being closed that contributed to the Obama campaign in 2008?

Florida Rep. Vern Buchanan learned from a House colleague that his Venice, Florida, dealership is on the hit list. Buchanan also has a Nissan franchise paired with the Chrysler facility in Venice.

“It’s an outrage. It’s not about me. I’m going to be fine,” said Buchanan, the dealership’s majority owner. “You’re talking over 100,000 jobs. We’re supposed to be in the business of creating jobs, not killing jobs,” Buchanan told News 10, a local Florida television station.

Buchanan, who succeeded former Rep. Katharine Harris in 2006, reportedly learned of his dealership’s termination from Rep.Candace Miller, R-MI. Buchanan owns a total of 23 dealerships in Florida and North Carolina.

Also fueling the controversy is the fact the RLJ-McCarty-Landers chain of Arkansas and Missouri dealerships aren’t being closed, but many of their local competitors are being eliminated. Go here for a detailed look at this situation. McClarty is the former Clinton senior aide. The “J” is Robert Johnson, founder of the Black Entertainment Television, a heavy Democratic contributor.

A lawyer representing a group of Chrysler dealers who are on the hit list deposed senior Chrysler executives and later told Reuters that he believes the closings have been forced on the company by the White House.

“It became clear to us that Chrysler does not see the wisdom of terminating 25 percent of its dealers. It really wasn’t Chrysler’s decision. They are under enormous pressure from the President’s automotive task force,” said attorney Leonard Bellavia.

RedState.com’s Josh Painter has a useful roundup of what has been found so far by a growing number of bloggers digging into what could be a very big story indeed. Also, see my column on this issue and how it fits into the larger context dubbed by the Examiner’s Michael Barone as “gangster government.”

As part of Chrysler’s bankruptcy agreement with the White House, the company plans to close roughly a quarter of its 3,200 dealerships. Lists of the dealerships being cut and those retaining their Chrysler franchises can be found here in pdf format. Many dealers contend the criteria being used to determine which dealerships survive is not clear and that many of those that are being closed in fact are profitable businesses, despite the current recession.

Sotomayor is also at the heart of the racial discrimination case

In addition to her statement that judges “make policy,” Sotomayor is also at the heart of the racial discrimination case involving white firefighters in New Haven, Connecticut. For a full report on this case, please check out my Loft post from April 20.

Matthew Marcarelli and a group of firefighters took and passed a promotion exam. However, “the city threw out the test because no blacks would have been promoted, saying the exam had a ‘disparate impact’ on minorities.”

Marcarelli actually finished #1 on the test, but was not granted a promotion. What kind of message does this send? Work hard, study, finish #1, and…. get skipped over. This is not “reverse” discrimination. It is just discrimination.

The case found its way to Sotomayor’s court where, as the Associated Press reports, “Sotomayor and two other judges issued an unusually brief decision that went against white firefighters.”

According to the AP, “The judges’ conservative colleagues on the court strongly criticized their terse decision. Today the Supreme Court appears to have serious questions about the ruling as well.”

So there we have it. This is the nominee being brought forward by Barack Obama. Whenever something like this happens, I can’t help but think back to the comments by Fox News commentators such as Fred Barnes and Bill Kristol who actually thought Obama would be a “pragmatic” leader. Hey guys… given the takeover of banks, the auto industry, energy taxes, health care takeover plans, and left-wing judicial nominees, do you think you might have a different opinion now?

By: Examiner Editorial, 05/24/09, Under the guise of due process concerns, congressional Democrats have opened the way for organizations with criminal histories to gain greater access to taxpayer funds. Exhibit A here is the Association of Community Organizers for Reform Now (ACORN), now under investigation in at least 14 states for voter registration fraud.

Earlier this month, House Financial Services Committee Chairman Rep. Barney Frank, D-MA, sponsored an amendment to the $140 million Mortgage Reform and Anti-Predatory Lending Act. The Frank measure allowed organizations being investigated by state or federal authorities on corruption charges to receive federal funds as long as they avoid conviction. Frank argued that his amendment, which was approved by the House, protected the presumption of innocence in federal spending.

Economic Enslavement verses Sovereign Civil Rights the Fight is On

This year the federal government will spend 50 cents for every dollar from borrowed money, the other half will come from taxes. America already in a recession comparable to the Great Depression will try to spend its way to prosperity by using a new totalitarian fascist model on its people for the first time since FDR’s presidency.

Americans are only hearing a liberal message that does not explain both sides of the issue with a idealistic concept that “government is here to help you!” The naive and uninformed headline reading public who have forgotten what independence and liberty are find themselves numbed into following leaders rather that questioning authority.

The federal government, elected and unelected bureaucrats are consuming more and more governing authority of states and localities, leaving them beholding to a massive authority that must borrow the funds to impose its complete will upon its subjects.

This is being done in complete contradiction to the constitution, and after losing case after case at the supreme court level states and local governments and the people they govern have resigned themselves to federal encroachment in their lives.

Economic slavery is now being forced upon Americans, and these once free and independent people are willingly submitting to government edicts as the Jews submitted to the Nazis walking unchallenged into genocide.

As you read the following article by Andrew Taylor, Associated Press the only objection to the full economic take over of a states economy by the Presidents budget is coming from States that will not allow their industries and resources to be stopped by new federal regulations to impose taxation for Social-Totalitarian spending programs.

It appears that economic slavery is a contentious issue among liberal progressives when it hits their pocket books, and when the public they serve are at risk by the federal government, but will they have enough authority to stop the largest private property grab by government in Americas history?

These same elected officials now battling to save their states from economic slavery have voted to empower the same government they are fighting with the ability to create $7.1 trillion in annual deficits over 2010-2019 with optimistic economic forecasts. The liberal progressive democrats controlling congress may battle to save a few of the electorate interests in their states but they have allowed a financial damage of massive debt to shackle their subjects like slaves to the will of the federal government.

It is the issue of economic slavery between the states and the federal government that will define the length of oppression by a new American totalitarian government just as it did following the civil war with the abolishment of slavery and the thirteenth amendment to the constitution.

The republicans in this debate are not sidelined but the awakening of senators and congressmen to the federal threat to freedom from economic slavery by its federal government is now more apparent than ever. How ironic that the battle for economic freedom will be waged liberals in government.

As slavery was originally enforced by the states then taken away by an amendment to the constitution, so should now the sovereign states lead the way for a new amendment to the constitution limiting the ability of the Federal Government to economically enslave the population by creating massive amounts debt.

White House: Budget deficit to top $1.8 trillion

White House: Budget deficit to top $1.8 trillion, 4 times 2008′s record,Andrew Taylor, Associated Press Writer, On Monday May 11, 2009, 10:31 am EDT

WASHINGTON (AP) — With the economy performing worse than hoped, revised White House figures point to deepening budget deficits, with the government borrowing almost 50 cents for every dollar it spends this year.

The deficit for the current budget year will rise by $89 billion to above $1.8 trillion — about four times the record set just last year. The unprecedented red ink flows from the deep recession, the Wall Street bailout, the cost of President Barack Obama’s economic stimulus bill, as well as a structural imbalance between what the government spends and what it takes in.

As the economy performs worse than expected, the deficit for the 2010 budget year beginning in October will worsen by $87 billion to $1.3 trillion, the White House says. The deterioration reflects lower tax revenues and higher costs for bank failures, unemployment benefits and food stamps.

For the current year, the government would borrow 46 cents for every dollar it takes to run the government under the administration’s plan. In one of the few positive signs, the actual 2009 deficit is likely to be $250 billion less than predicted because Congress is unlikely to provide another $250 billion in financial bailout money.

The developments come as the White House completes the official release of its $3.6 trillion budget for 2010, adding detail to some of its tax proposals and ideas for producing health care savings. The White House budget is a recommendation to Congress that represents Obama’s fiscal and policy vision for the next decade.

Annual deficits would never dip below $500 billion and would total $7.1 trillion over 2010-2019. Even those dismal figures rely on economic projections that are significantly more optimistic — just a 1.2 percent decline in gross domestic product this year and a 3.2 percent growth rate for 2010 — than those forecast by private sector economists and the Congressional Budget Office.

For the most part, Obama’s updated budget tracks the 134-page outline he submitted to lawmakers in February. His budget remains a bold but contentious document that proposes higher taxes for the wealthy, a hotly contested effort to combat global warming and the first steps toward guaranteed health care for all.

Obama’s Democratic allies controlling Congress have already made it clear that they will reject key elements of his plan. Already apparently dead is a plan to raise $267 billion over the next decade to pay for his health care initiative by curbing the ability of wealthier people to reduce their tax bills through deductions for mortgage interest, charitable contributions and state and local taxes.

And the congressional budget plan approved last month would not extend Obama’s signature $400 tax credit for most workers — $800 for couples — after it expires at the end of next year.

Obama’s remarkably controversial “cap-and-trade” proposal to curb heat-trapping greenhouse gas emissions is also reeling from opposition from Capitol Hill Democrats from coal-producing regions and states with concentrations of heavy industry. Under cap-and-trade, the government would auction permits to emit heat-trapping gases, with the costs being passed on to consumers via higher gasoline and electric bills.

Among the new proposals is a plan — already on its way through Congress — that would increase the Federal Deposit Insurance Corporation’s borrowing authority from $30 billion to $100 billion in order to grant a two-year reprieve from higher deposit insurance premiums while the industry is struggling.

Also new are several tax “loophole” closures and increased IRS tax compliance efforts to raise $58 billion over the next decade to help finance Obama’s health care measure. The money makes up for revenue losses stemming from lower-than-hoped estimates of his proposal to limit wealthier people’s ability to maximize their itemized deductions.

The updated budget also would repeal an unintended tax windfall taken by paper companies that use a byproduct in the paper-making process as fuel to power their mills. The tax credits were never intended for paper companies, but now they could be worth more than $3 billion a year, according to a congressional estimate.

The budget would make permanent the expanded $2,500 tax credit for college expenses that was provided for two years in the just-passed economic stimulus bill. It also would renew most of the Bush tax cuts enacted in 2001 and 2003, and would permanently update the alternative minimum tax so that it would hit fewer middle- to upper-income taxpayers.

The New Deal Economic Ideology Now Firmly in Control

“I say after eight years of this Administration we have just as much unemployment as when we started. … And an enormous debt to boot!” Henry Morgenthau Jr. Treasury Secretary to President Franklin D. Roosevelt. Indeed, Morgenthau confessed what so many keepers of FDR’s flame won’t admit: The New Deal failed. Massive spending on public works programs didn’t erase historic unemployment. It didn’t produce a recovery.

1930 to 1942 New Deal policies prolonged unemployment and slowed industry economic growth due to government competition with the free market, stimulus plans like the Tennessee Valley Authority provided government employment but were unsustainable. It is now a known fact among economist that the great depression would have ended in 1936 instead of 1943 had not government policy makers intervened in the free market.

By government taxation, dollars are removed from private citizens and given to another sector of society, not adding value to the economy but taking away from it. By massive borrowing, government bailouts, and totalitarian regulations the new fascist-private sector cannot compete in the international business sector that does not have a yoke of regulation placed upon it. In a world economy, nationalized industry with profit driven priorities set by unqualified bureaucrats and labor unions, cannot possibly compete against freer market forces of foreign nations.

The seeds of Comrade President Obama New Deal Policies are just being sewn into the fabric of American economy. Nothing adverse has happened yet, public sentiment is on the rise as shown by the rising DOW but the marxist-fascist seeds have not had time to germinate into weeds that will choke any contemplated recovery by the unsuspecting public. Wait 10 months for the seeds of our coming discontent to reach maturity.

There is a direct conflict with Obama’s doctrine of idealism over reason evidenced by history. Under similar market conditions President Reagan implemented economic programs based upon free market principals, resulting twenty-five years of economic prosperity and freedom.

The liberal progressive does not commit to logic and reason as the conservative but to tactics of condemnation and oppression of dissenting voices not to participate in a dialogue of what is the correct economic course but in a Hitler like allegiance to ideals over substance, control over freedom, and lies over truth. With NBC, the New York Times, and their willing media affiliates, a President ordering the break in at the Watergate Hotel would never be brought to the public’s attention. Comrade President Obama is freely imposing a marxist-fascist totalitarian agenda on an unsuspecting America. People who have never known oppression, who believe in their leaders and government, and who have been taught in school and by media inculcation to obey idealism over reason.

While in 2009 unemployment continues and economic recovery of Americas industrial, commercial and financial sector base cannot get started due to unfettered foreign competition without high taxation and higher labor costs, the issue of the economy will come back to the political table. Yet who will have the principals, initiative, and communication skills to confront a political leader that has a massive organized machine funded by federal dollars, and the clout of fear by anyone who would oppose him?

If any American has not seen the vicious attacks against people speaking out against the progressive liberal agenda and its leader, they will soon see greater and more blatant political oppression as party power grows. The corruption of power is here as never before in America. The Democratic Party systematically shuts down voices of opposing views to those resonating reasonable totalitarian tones.

“The Party” led by ideology is now debating the re-imposition of the fairness doctrine and removal of contrary opinion to its authority. Look for “the party and its affiliates” to shut down opposition, just as Hitler did in taking full control over Germany. Opposition to Party Ideology will be dealt with swiftly and through federal government offices such as the IRS, FBI, Homeland Security, military and other surveillance arms of government.

No More Lies Mr. President!

Comrade President Obama told the American public that he would not nationalize banks. Now when a large bank tries to payback with interest its TARP funds he won’t allow it. Americans and any recovery need to be based on trust. This is the way American markets have worked since inception of the original thirteen colonies. With a Government warranty of GM products as if it is the car manufacturer taking an active role in the management by terminating its CEO, how can the public and market place develop trust in a government that is actively attacking American financial and manufacturing institutions?

Obviously, government will not allow these institutions to fail, and so will pour billions and billions more into them because that is the only technical ability of government, to spend other people’s money. There is no moral compass at the head of Congress or the Executive branch, as honesty and egocentric authority and irrational behavior appear as the new norm. These are not principals of recovery but those of fascism.

The US government has raised FDIC insured deposits to $250,000 this guarantee is taken seriously by the nation’s depositors. Now that these new government insurance levels have been created people feel their deposits are safe. Few people realize that the FDIC is broke, the only way to pay off depositors is to create money out of thin air there is nothing backing up this insurance but the printing press. The FDIC is making a broken promise to Americans.

In the coming depression the FDIC will be called upon to pay off depositors worthless obligations in deflated real estate investments. It appears the Treasury Secretary and Fed Chairman are already facing this crisis but have not told the American public how severe the problem is at present. The last thing the Treasury wants to do is set off a panic.

America’s new IOU debt obligations for the trillions borrowed by foreign governments, individual bond holders, and banks at this time are so great, that as the crest of the economic tsunami breaks toward depression, Comrade President Obama’s administration will see its tax revenues contract even further. Treasury Secretary Geithner and Fed Chairman Bernanke will be hard pressed to pay the interest on this debt, let alone principal payments. This same situation is amplified by all the other nations of the world that have bought into the risk of motivating their economies on government capital inflows into both the public and private sectors with more debt. America’s annual debt is at GDP levels, its loan to value ratio will be negative by the end of the year. Other countries are in a worse position!

When sovereign nations begin to default, which we are predicting will happen later this year, the international cost of borrowing will jump or possibly stop all together. The Fed is purchasing toxic bank debt at 10 cents on the dollar, or $100 billion guarantee for $1 trillion exposure. It is no longer a non-partisan player but an active participant in using monetary policy to further a partisan Marxist-fascist agenda on behalf of the Administration.

How will the pieces get picked up by the American people when the crashing wave of debt crumbles upon the economy and the only people who can bring innovation, talent and ability to resolve catastrophe, are shackled with so much government regulation, taxation, and control that they are immobilized and can only sit by and wait for their inflated welfare check, which will be taxed!

By the time congress and the Marxist-fascist administration changes by elections, if the ballot boxes have not been filled by democrat sponsored Gestapo tactics, getting government off the backs of Americans will be four years off. Until government sponsored economic terrorism is destroyed in America and the full potential of the American people is unleashed, there can be no recovery, only a small parasitic government induced growth that will suck the life force from the economy to sustain itself, through taxation.

The private sector has always lead America out of every recession and built the strongest economy in the world, but only when government has gotten off its back and out of the way.
